On November 30, 1954 plaintiff William Ashmus caused to be issued a summons and complaint against the defendant R. P. Donohoe, a nonresident, doing business as O. K. Donohoe Company, and a garnishee summons against Donohoe and the garnishee defendant John Hennes Trucking Company, both returnable December 10, 1954. Plaintiff filed his affidavit of garnishment stating that he claimed $10,000 from the principal defendant on contract. The garnishee defendant was served with the summons on the day it was issued but no service was obtained on the principal defendant. The John Hennes Company answered that it had in its possession a stonecrusher of the defendant. On December 6, 1954 Donohoe caused to be filed with the court a surety bond offering to permit the entry of judgment for the plaintiff against him in the main action. The garnishee defendant was thereupon released. On December 9, 1954 a notice of retainer for special appearance was filed on behalf of Donohoe by Eugene J. Sullivan and Dennis M. Sullivan, the same attorneys who filed the bond. On March 17, 1955 the court heard the arguments of counsel on plaintiffs motion to compel Donohoe to file an answer, after which the court entered its order upholding defendants special appearance and denying plaintiffs motion. From said order plaintiff appeals.
